Partner or Spouse migration allows Australian citizens, permanent residents and eligible New Zealand citizens to sponsor their partner (spouse, fiancé, de facto or interdependent partner) to migrate to Australia.
To be eligible for a Partner visa, you must be married, engaged to be married, in a de facto or interdependent relationship with an Australian citizen, permanent resident or eligible New Zealand citizen.
In addition to this, your relationship must be genuine and ongoing and you must have a mutual commitment to a shared life together to the exclusion of all others.
There are two different types of visas available under the Partner visa category:
In order to qualify for a spouse / de facto visa, you must be either legally married to, or in a de facto relationship with an Australian citizen, permanent resident or eligible New Zealand citizen. To meet the requirements for a de facto relationship, in most cases you must have been living together in a committed relationship for a minimum period of 12 months prior to lodgement. The 12-month requirement may not apply in certain circumstances for example, you have registered your relationship with an Australian authority such as a registry of births, deaths and marriages.
Applying for a Partner visa as a spouse or de facto partner is a two stage process towards permanent residency that is applied for as a combined application.
A spouse / de facto visa can be lodged onshore or offshore depending on the applicant’s location.
In order to qualify for a fiancé visa, among other things, you must be engaged to an Australian citizen, permanent resident or eligible New Zealand citizen. A fiancé visa application visa cannot be lodged in Australia. Once approved, you must marry your spouse within 9 months of the initial fiancé visa being granted.
Applying for a Fiancé’ (or Prospective Marriage visa) is a three stage process towards permanent residency.
